I was asked to look at and advise on the ‘development’ of a basement over which my Client has a right of way. The neighbour wants this right to be ‘extinguished’ – a legal term apparently – so he can extend into the basement from his ground floor flat. A good idea, but that right of way could be worth a small fortune, as my Client is not bound to give in and the other party has no right to it. Stokes v. Cambridge comes to mind.
